SERVICE AGREEMENT
PARTIES
1) KIWI EDUCATION (Kiwi Success Group Limited) (hereinafter referred to as “the Company”)
2) CLIENT
1. Scope of Services
The Company agrees to provide the Services, and the Client agrees to accept the Services in accordance with the terms of this Agreement.
2. Description of Services
2.1. The Services include assistance with the enrollment process and visa application through the provision of information and consultations on studying in the selected country. This includes program selection, preparation of required documents, and other related matters. Services are provided according to the selected service package.
2.2. The service package includes the processing of two invitations from educational institutions. Each additional invitation is charged separately at $99.
3. Payment Terms
Services are provided for a fee. Service package costs are determined according to the rates listed on the Company’s website.
4. Payment Schedule
Full payment must be made before the Services begin.
5. Excluded Costs
The service fee does not include visa fees, service center fees, document translation costs, or administrative fees paid to third parties. These expenses are borne by the Client, who must also provide proof of payment to the Company.
6. Non-Refundable Cases
The Service is considered duly rendered and is non-refundable in the following situations:
- If the visa (student or limited) is approved, but the Client decides not to travel for personal reasons or is unable to travel due to circumstances under the Client’s control;
- If the Client withdraws from the process after receiving the list of required documents and visa instructions;
- If the Client, after payment, decides to pause the process, the Company reserves the right to retain the payment and resume services upon mutual agreement. If the service cost changes by the time of resumption, the Company may revise the price and request the Client to pay the difference in accordance with the current price list.
7. Client Responsibilities
7.1. The Client must provide accurate and truthful information requested in the application form on the Kiwi Education website. If the Client provides false or incomplete information before, during, or after entering into this Agreement, the Client assumes all associated risks.
7.2. The Client must review Appendix 1 to this Agreement and inform the Company before the start of the Services if they are unable to provide the required supporting documents in full.
8. Company’s Right to Refuse Services
8.1. The Company may terminate Services and retain the full service fee in the following cases:
- If it is discovered during the documentation process that the Client provided incomplete or inaccurate information which significantly reduces the chances of obtaining a visa.
8.2. The Company may also terminate the Services and retain $99 for consultation if the Client is unable to provide documents listed in Appendix 1, and this fact is discovered before receiving an invitation from an educational institution. If discovered after receiving the invitation, the Company will retain $199. Once visa application preparation has begun, the entire service fee is retained.
These amounts reflect actual administrative costs.
9. Limitation of Liability
The Services are strictly informational and consultative. The Company is not responsible for:
- Visa processing times or final decisions made by visa officers;
- Changes in educational programs or institutional policies;
- Rejection by an educational institution for reasons beyond the Company’s control.
10. Communication
All operational matters, including consultation dates and times, will be coordinated via email, phone calls, or messaging apps.
11. Acceptance of Services
Service completion does not require a signed acceptance certificate.
12. Governing Law
This Agreement and the parties’ obligations are governed by New Zealand. However, the document requirements for visa processing shall comply with the legal regulations of the country of application.
13. Dispute Resolution
All disputes must be resolved through a mandatory pre-litigation claim procedure. Claims must be reviewed within 10 days, and must be accompanied by supporting documentation.
14. Validity Period
The services are valid for 2 years from the date of payment. The service is considered rendered upon the expiration of this period or under the conditions specified in Clause 6.
APPENDIX 1
Checklist
- Official* proof of employment, education, or internship for the past 10 years, with no gaps**
- Ability to provide a certificate from the current employer***
- Education beyond high school****
- Sufficient funds to cover the planned study and basic living expenses in the chosen country
- Ability to provide a bank statement showing account activity for the past 6 months and proof of legal source of funds
- No criminal record
- No history of visa refusals or deportations
- Willingness to undergo a chest X-ray and/or medical exam and submit results from a licensed clinic in the relevant country, if required*****
* Acceptable proofs of employment include: an employment contract, labor book, tax payment certificate, or pension fund contributions (at least one of these per job held)
** A gap is defined as a break of more than 6 months

**** Not required for recent high school graduates entering university
***** Required for stays in New Zealand of 6+ months, or in other countries if applicable
